These Terms of Service ("Terms") govern your use of the Ultra Spray website and any purchase you make from Ultra Spray ("Ultra Spray", "we", "us", "our"). Please read them carefully before placing an order. By placing an order you confirm that you have read and agree to these Terms, our Shipping & Delivery Policy, our Refund Policy and our Privacy Policy, which together form the contract between us.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or, if you are in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, that cannot lawfully be excluded. If you are acquiring goods for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply to the extent permitted by section 43 of that Act.
1. About Us & How to Contact Us
Ultra Spray is a company registered in Australia with its registered office at 69 Prestige Parade, Wangara, Western Australia 6065. You can contact us by email at support@ultraspray.co. If we need to contact you, we will do so using the email address or telephone number you provided with your order.
2. Eligibility & Use of the Website
You must be at least 18 years old to place an order. You agree to use the website lawfully and not to interfere with its operation or security. We may suspend or withdraw access to the website where these Terms are breached or where we reasonably suspect fraudulent or unauthorised activity.
3. Products, Pricing & Availability
Prices are displayed in Australian dollars (AUD) and include GST for orders delivered within Australia. Delivery charges, where any apply, are shown at checkout before you confirm your order. Where we display a "was" or comparison price, it is a price at which the product was genuinely offered by us for a reasonable period before the promotion. We take reasonable care to ensure prices and descriptions are accurate; if we discover a clear error in the price of goods you have ordered, we will contact you before dispatch to confirm whether you wish to proceed at the correct price or cancel for a full refund. Product images are illustrative and minor variations in colour or finish may occur. All products are subject to availability.
4. Orders & Contract Formation
Your order is an offer to purchase. We will send an acknowledgement email on receipt; a binding contract is formed only when we send you a dispatch confirmation. We may decline an order, or limit quantities, where goods are unavailable, where a pricing or description error has occurred, where we cannot verify payment or identity, or where we reasonably suspect fraud or purchase for unauthorised resale. If we decline an order after payment has been taken, we will refund you in full without delay.
5. Payment
Payment is taken in full at the time of order. We accept the payment methods displayed at checkout, including major debit and credit cards, Apple Pay, Google Pay and PayPal. Payments are processed securely by our payment service providers, Shopify Payments (operated by Stripe) and Stripe Payments Australia Pty Ltd; we do not store your full card details, and card data is handled in a PCI DSS-compliant environment. We do not charge a surcharge for any payment method. Our payment providers may carry out fraud and identity checks, including 3-D Secure authentication, and we may request further verification before dispatch. By submitting payment you confirm that you are authorised to use the payment method provided. The name that will appear on your card statement is Ultra Spray.
6. Dispatch & Delivery
Orders are dispatched within 3–5 business days of order confirmation. Estimated delivery after dispatch is 3–8 business days within Australia and 6–12 business days to New Zealand. Standard delivery within Australia is free; New Zealand rates are displayed at checkout. Our products contain lithium-ion batteries and are transported in accordance with dangerous-goods regulations, which may limit the services available. Full details, including tracking and New Zealand import charges, are set out in our Shipping & Delivery Policy, which forms part of these Terms.
Delivery timeframes are estimates. We will supply goods within a reasonable time; if we have not dispatched your order within 15 business days of order confirmation, or within any timeframe expressly agreed with you, you may cancel and receive a full refund. Risk in the goods passes to you on delivery; ownership passes once we have received payment in full.
7. Change of Mind & 60-Day Satisfaction Guarantee
Consumer law does not oblige us to accept returns where you have changed your mind. We nonetheless offer a voluntary 60-day satisfaction guarantee from the date of delivery. To qualify, goods must be returned in a clean and resaleable condition with original packaging, manuals and accessories, and you are responsible for return postage. Items marked "Final Sale" or "Non-Returnable" are excluded from the guarantee unless faulty. Where you return part of a discounted bundle, the remaining items are re-priced at their standard individual price and the refund adjusted accordingly.

8. Consumer Guarantees & Faulty Goods
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. New Zealand consumers have equivalent rights under the Consumer Guarantees Act 1993. Where goods are faulty, we will cover the reasonable cost of return. Please contact us as soon as possible with your order number and a description (and, where possible, photographs) of the fault so we can resolve the matter quickly.
9. Warranty Against Defects
Ultra Spray products are covered by a 2-year replacement warranty against defects in materials and workmanship under normal domestic use, from the date of purchase. An optional 10-Year Extended Warranty may be purchased at checkout, which extends the period to ten years and covers the sprayer body and motor. If a covered defect arises, contact us at support@ultraspray.co with your proof of purchase and a description of the fault; once we have assessed the product, we will replace it with a new or refurbished equivalent, or issue a refund where replacement is not reasonably possible. Reasonable return postage for a valid claim is covered by us. The warranty does not cover normal wear and tear, cosmetic damage, consumable parts such as nozzles and batteries, damage caused by misuse, neglect, accident, modification or unauthorised repair, or products used for commercial or industrial purposes. The warranty is provided by Ultra Spray, 69 Prestige Parade, Wangara WA 6065, and is provided to the original purchaser.
The benefits given by this warranty are in addition to other rights and remedies you have under a law in relation to the goods to which the warranty relates.
10. Promotions & Discount Codes
Promotional offers and discount codes are subject to the specific terms stated at the time of the promotion, may be withdrawn at any time, cannot be exchanged for cash and, unless stated otherwise, cannot be combined with other offers. Where a code is misused or applied in error, we may cancel the order and refund you in full.
11. Product Restrictions & Safe Use
Our products contain lithium-ion batteries and are subject to transport and safety regulations, which may restrict delivery to some addresses and the services available. Products must be used in accordance with the instructions and safety information supplied, including charging only with the supplied charger and not exposing batteries to heat, water or physical damage. We are not responsible for loss or damage arising from use contrary to those instructions, to the extent permitted by law.
12. Intellectual Property & User Content
All content on this website, including text, images, logos, product descriptions and design, is owned by or licensed to Ultra Spray and protected by intellectual property law. You may not reproduce or use it without our prior written consent. By submitting a review or other content, you grant us a non-exclusive, royalty-free, perpetual licence to use, edit and publish it, and you confirm it is genuine, accurate and does not infringe the rights of others. We may remove any content at our discretion.
13. Third-Party Links
Our website may link to third-party sites or tools. We do not control and are not responsible for their content or terms, and any use of them is at your own risk.
14. Our Liability
To the extent permitted by law, our liability for breach of a consumer guarantee in relation to goods that are not of a kind ordinarily acquired for personal, domestic or household use is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so. We are not liable for loss that is not reasonably foreseeable, or for any business loss where you are a consumer. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded, including under the Australian Consumer Law or the Consumer Guarantees Act 1993.
15. Complaints & Dispute Resolution
If you are unhappy with any aspect of your order, please contact us first at support@ultraspray.co and we will do our best to resolve the matter promptly. If we cannot resolve your complaint, you may contact the consumer protection agency in your state or territory, the Australian Competition and Consumer Commission (ACCC), or, in New Zealand, the Commerce Commission or the Disputes Tribunal.
16. Changes to These Terms
We may update these Terms from time to time; the current version is published on this page with its effective date. Changes do not affect orders already placed, which are governed by the Terms in force at the time of your order.
17. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision does not waive our right to do so later. These Terms are personal to you and may not be transferred without our consent.
18. Governing Law & Jurisdiction
These Terms and any contract between us are governed by the laws of Western Australia and the Commonwealth of Australia. You may bring proceedings in the courts of Western Australia. If you are a consumer resident in New Zealand, you retain the benefit of any mandatory consumer protections under New Zealand law and may bring proceedings in the courts or tribunals of New Zealand.
